This Medical Disclaimer ("Disclaimer") applies to the HEAL telemedicine platform ("HEAL," the "Platform," or the "Service") operated by NoxSoft PBC (incorporation pending) ("NoxSoft," "we," "us," or "our"). This Disclaimer should be read in conjunction with our Terms of Service and Privacy Policy.

HEAL is NOT a substitute for professional medical advice, diagnosis, or treatment. Never disregard professional medical advice or delay in seeking it because of information obtained through the HEAL platform or its AI triage system. If you think you may have a medical emergency, call your local emergency number immediately.

1. General Disclaimer

1.1. The information and tools provided through the HEAL platform, including but not limited to the AI triage system, symptom checker, health information content, and general wellness information, are provided for informational and educational purposes only.

1.2. The Platform is not intended to be, and must not be used as, a substitute for professional medical advice, diagnosis, or treatment from a qualified healthcare provider. The Platform does not provide medical advice. Only a licensed healthcare provider can provide medical advice.

1.3. Never disregard professional medical advice or delay in seeking medical treatment because of information you have read on or received through the HEAL platform. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

1.4. Reliance on any information provided by the Platform, including AI-generated outputs, content provided by Healthcare Providers through the Platform, or other users of the Platform, is solely at your own risk.

2. AI Triage System Disclaimer

2.1. The HEAL AI triage system is a decision-support tool designed to assist users in understanding the potential urgency of their symptoms and to facilitate appropriate connections with licensed Healthcare Providers. It is not a diagnostic tool.

2.2. The AI triage system does not diagnose medical conditions, recommend specific treatments, prescribe medications, or provide medical advice. Its outputs, including urgency assessments, specialist recommendations, and general health information, are generated by machine learning algorithms based on the information you provide and are inherently limited.

2.3. Limitations of the AI triage system include but are not limited to:

  • The system relies solely on the symptoms and information you describe. It cannot perform physical examinations, order or interpret laboratory tests, review imaging studies, or access your complete medical history beyond what you provide.
  • The system may not recognize all symptoms or conditions, particularly rare conditions, atypical presentations, or complex multi-system disorders.
  • The system's outputs are based on statistical models and may not account for individual variations in health, genetics, lifestyle, or concurrent medical conditions.
  • The system may produce false positives (identifying urgency where none exists) or false negatives (failing to identify urgency where it exists).
  • The system's knowledge is based on its training data and may not reflect the most current medical research, guidelines, or emerging conditions.
  • The system cannot replace the clinical judgment, experience, and expertise of a licensed healthcare practitioner.

2.4. Users must not rely solely on AI-generated outputs for any healthcare decisions. All AI-generated information should be discussed with a qualified healthcare provider who can properly evaluate your individual circumstances.

3. Doctor-Patient Relationship

3.1. The doctor-patient relationship on the HEAL platform is formed directly between the patient and the independently licensed Healthcare Provider who conducts the consultation. This relationship is governed by the applicable medical practice standards, ethical obligations, and regulations of the Healthcare Provider's jurisdiction.

3.2. NoxSoft does not form a doctor-patient relationship with any user of the Platform. NoxSoft is a technology platform provider. Using the AI triage system, browsing health information, or creating an account on the Platform does not create a doctor-patient relationship between you and NoxSoft.

3.3. Healthcare Providers on the Platform are independently licensed medical practitioners. They are not employees, agents, or representatives of NoxSoft. NoxSoft does not supervise, control, or direct the clinical judgment, medical opinions, diagnoses, prescriptions, or treatment plans of Healthcare Providers.

3.4. The treating Healthcare Provider is solely responsible for all clinical decisions made during consultations conducted through the Platform, including the decision to accept or reject AI triage outputs.

4. Emergency Situations

HEAL is NOT an emergency medical service. If you believe you or someone else is experiencing a medical emergency, CALL YOUR LOCAL EMERGENCY NUMBER IMMEDIATELY.

4.1. The HEAL platform, including the AI triage system, is not designed to handle medical emergencies. The Platform cannot dispatch emergency services, provide real-time emergency medical guidance, or substitute for emergency medical care.

4.2. While the AI triage system may detect symptoms that could indicate an emergency and will direct users to call emergency services, this functionality is provided as an additional safety measure and is not a substitute for emergency medical services. The AI system may fail to detect all emergency symptoms.

4.3. Do not delay seeking emergency medical care because you are waiting for a response from the AI triage system, a Healthcare Provider on the Platform, or any other feature of the Platform.

5. Professional Responsibility of Healthcare Providers

5.1. Healthcare Providers who offer services through the HEAL platform are independently responsible for their professional conduct and clinical decisions. Each Healthcare Provider is responsible for:

  • Exercising independent clinical judgment in all patient interactions, regardless of AI triage outputs or platform-generated recommendations.
  • Performing an adequate clinical assessment before rendering medical opinions, diagnoses, or treatment plans.
  • Obtaining informed consent from patients, including disclosing the limitations of telemedicine consultations.
  • Prescribing medications and treatments in accordance with applicable regulations, clinical guidelines, and the standard of care.
  • Recognising the limitations of telemedicine and referring patients for in-person evaluation when clinically appropriate.
  • Maintaining complete and accurate medical records for all consultations.
  • Complying with all applicable mandatory reporting obligations, including but not limited to communicable disease reporting, child abuse reporting, and adverse event reporting.
  • Maintaining current, valid medical licensure and adequate professional liability insurance.

5.2. NoxSoft does not assume responsibility for the professional conduct, clinical judgment, or compliance of Healthcare Providers. The AI triage system is a tool available to Healthcare Providers, not a directive. Healthcare Providers must use their own professional judgment in evaluating and treating patients.

6. Patient Responsibility

As a patient using the HEAL platform, you acknowledge and agree that:

  • You are responsible for providing accurate, complete, and truthful information about your symptoms, medical history, current medications, allergies, and pre-existing conditions to both the AI triage system and Healthcare Providers.
  • You understand that incomplete, inaccurate, or misleading information may result in inaccurate AI triage outputs and may adversely affect the quality of care you receive from Healthcare Providers.
  • You are responsible for following the medical advice and treatment plans provided by your Healthcare Provider, and for seeking clarification if you do not understand any aspect of your diagnosis or treatment.
  • You are responsible for attending follow-up appointments and seeking in-person medical care when recommended by your Healthcare Provider.
  • You understand that telemedicine consultations have inherent limitations compared to in-person medical examinations and that certain conditions may require in-person evaluation.
  • You will not use the Platform to obtain controlled substances inappropriately or for purposes other than legitimate medical treatment.

7. Jurisdiction-Specific Disclaimers

7.1 Australia

Healthcare Providers practising in Australia through the Platform must be registered with the Australian Health Practitioner Regulation Agency (AHPRA) and hold current registration with the Medical Board of Australia. Telehealth consultations must comply with the guidelines issued by the Medical Board of Australia and the relevant state/territory health legislation. Nothing in this Disclaimer limits any rights you may have under the Australian Consumer Law.

7.2 United States

Healthcare Providers practising in the United States through the Platform must hold a valid, unrestricted medical licence in the state(s) where the patient is located at the time of the consultation. Telemedicine services must comply with the applicable state telemedicine laws and regulations, which vary by state. The AI triage system has not been evaluated by the U.S. Food and Drug Administration (FDA) and is not intended to diagnose, treat, cure, or prevent any disease. The AI triage outputs are not Clinical Decision Support (CDS) as defined by FDA regulations.

7.3 India

Healthcare Providers practising in India through the Platform must be registered with the National Medical Commission (NMC) or the applicable State Medical Council. Telemedicine consultations must comply with the Telemedicine Practice Guidelines issued by the Board of Governors (superseding the Medical Council of India) dated March 25, 2020, and any subsequent amendments or replacements thereof. Prescriptions issued through the Platform must comply with the applicable provisions of the Drugs and Cosmetics Act, 1940, and the rules made thereunder.

7.4 United Kingdom

Healthcare Providers practising in the United Kingdom through the Platform must be registered with the General Medical Council (GMC) and hold a licence to practise. Telemedicine consultations must comply with the GMC's guidance on remote consultations and prescribing. Prescriptions must comply with the Human Medicines Regulations 2012. Nothing in this Disclaimer affects your statutory rights under UK consumer protection legislation.

7.5 Canada

Healthcare Providers practising in Canada through the Platform must hold a valid licence from the College of Physicians and Surgeons in the province or territory where the patient is located. Telemedicine consultations must comply with the applicable provincial and territorial telemedicine standards and guidelines. Prescriptions must comply with the applicable provincial and federal prescribing regulations, including the Controlled Drugs and Substances Act where applicable.

8. No Guarantee of Outcomes

8.1. NoxSoft does not guarantee any specific health outcomes from the use of the Platform, the AI triage system, or consultations with Healthcare Providers. Medical outcomes depend on numerous factors beyond the control of the Platform, including but not limited to the accuracy and completeness of information provided by the patient, patient compliance with treatment plans, individual health variations, and the inherent uncertainties of medical practice.

8.2. NoxSoft does not warrant that the AI triage system will correctly identify the nature or urgency of every symptom or condition. NoxSoft does not warrant that Healthcare Providers will be available at all times or that consultations will result in a diagnosis or treatment plan.

8.3. The fact that a Healthcare Provider is available on the Platform does not constitute an endorsement, recommendation, or guarantee by NoxSoft of the Healthcare Provider's competence, qualifications, or the quality of care they will provide.

9. Third-Party Content

9.1. The Platform may display or link to health information, articles, or resources provided by third parties. NoxSoft does not control, endorse, or assume responsibility for the accuracy, completeness, timeliness, or reliability of any third-party content.

9.2. Third-party health information is provided for general informational purposes only and should not be considered medical advice. Always consult a qualified healthcare provider before making any health-related decisions based on third-party content.

10. Telemedicine Limitations

Users should be aware that telemedicine consultations have inherent limitations compared to in-person medical consultations, including but not limited to:

  • The Healthcare Provider cannot perform a physical examination.
  • The quality of the consultation may be affected by technical factors such as internet connectivity, audio/video quality, and device capabilities.
  • Certain medical conditions cannot be adequately assessed or managed through telemedicine and require in-person evaluation.
  • The Healthcare Provider may not be able to prescribe certain medications (particularly controlled substances) through telemedicine, depending on the applicable jurisdiction.
  • Telemedicine consultations may not be suitable for all medical conditions or all patients.

The Healthcare Provider is responsible for determining whether a telemedicine consultation is appropriate for your specific situation and for referring you for in-person care when necessary.

11. Updates to This Disclaimer

We may update this Medical Disclaimer from time to time to reflect changes in our services, applicable laws, or regulatory guidance. Material changes will be communicated through the Platform. The "Last Updated" date at the top of this page indicates when the Disclaimer was last revised.
